can i just fill out a deed in lieu of foreclosure without speaking to the servicing mortgage company. i do not have any liens, second, and everything is current until today feb 1st, 2011. the house has gone down 60% it's value and it's an empty rental house. the house has been empty for 3 months. the property is in california.

It is your mortgage lender who has to agree to a deed in lieu of foreclosure. Unless he agrees to it, you won't be able to sell off the property in a deed in lieu of foreclosure auction.
