I have a court date coming up fast for the first movement on forclosure, I was thinking of trying to work with the lender to agree on a DIL and ask that we do this together and the house would be in great shape for them. My question is do I speak with the attorney they hired or them direct or go to court?? How do I ask them to give me a couple more months to find a place to go and get the property in sellable standards for them?
if i were in your situation, i would a) speak with the attorney; b) speak with the lender/servicer directly; and c) go to court.

in other words, try any and all methods to let them know of my intent and desire to work with them for the benefit of all concerned.

Definately do all three--talk with loan servier, go to court and let judge know you are attempting to do a DIL with lender and need a continuance 90 or more days out, and talk with their attorney. The attorney will unlikely have any authority other than to foreclose but s/he will be your best bet in getting the lender/servicer to actually do something.

Many servicers will require you to jump through hoops and provided specifice information before any request will be considered so talk with the servicer ASAP.

Finally, consider hiring an attorney. Those with attorneys are usually more likely to get a DIL or short sale as they will likely be able to stall the foreclosure process.
