My ex wife has been living in the family home since the divorce was final (nearly a year ago) and we have it in the divorce papers that we will both continue to make half of the payments till it sells. It hasn't sold in that time and I am supposed to have equal access to the home but she has locked me out of getting in the home to show it to potential buyers. She is paying her half and residing there but I am paying my half and having to live with my my family because I cannot afford my own place of residence due to making half of the payments all this time. I want to let it go into foreclosure now because I have exhausted all means of trying to rid both of us of this burden. She has a great thing going with all this (making half the payments and getting to reside there) and has made no efforts to sell
It sounds like you need to get in front of the judge.
Hi
Since you've been making half of the payments you should have a right to the property. You can take her to court for denying you the right to stay in the property. If you want to let it go into foreclosure you can simply stop making the monthly payments. But this will ruin your credit and will make it difficult for you to get a mortgage in near future.
