This is a slightly complicated, lengthy question.
I was divorced last yr. after an abusive marriage. In order to get alimony, I gave ex our house. ( we owed more than it was worth & it needed major repairs.) I have a disability & 2 young children ( one who has a genetic desease & is classified "special needs.")
I left my home very quickly, since I could not afford the bills with alimony as only income, but did give my ex-husband proper notice, as promised in our settlement. Unfortunately, I couldn't remove all of the childrens' belongings, or my own, at the time that I left. I did get the most important things & have been back several times for as much as I could physically handle, alone.
The kids & I, now live with my parents, and I'm wondering how much time there is, for me to get our things from our old house?
This is not a matter of my ex not allowing it, but he's not keeping me up-to-date, on the foreclosure of the house, as I was told he would have to. ( & I cannot afford more court etc..)
The home is empty.(no electric, etc..) Ex currently rents an apt. and chose not to move into the house~said it was too costly to keep. I was told there'd be a short sale, but never heard another word. I did see a letter last time I was at the house ( from mortgage co.- offering "HAMP," in 2nd. wk of Oct. It said it was 2nd. notice?) The bank is not sending any notices to me, but my ex tries to tell me that we are "both" responsible for the house/ foreclosure? (my name was on original deed, not mortgage, I'm told?)
Can anyone tell me what that letter may indicate? I am terrified of not being able to get my childrens things from the only home they've ever known, but due to my medical condition, I need to know how much time I could have to get our things out of the old house.
**Also, neighbors have compained about the abandoned house! Can't blame them, they are trying to sell theirs. Ex did take care of yard recently. That's all I know about.

You should remove your belongings as soon as possible. If the property is sold off at the foreclosure auction, you won't get much time to remove your things. Thus, it is always better to remove your assets as soon as possible.
You need to check out whether or not your name is mentioned on the mortgage docs. If your name is not mentioned on the mortgage docs, then you are not liable for the mortgage. However, if your name is on the mortgage docs, then you will be liable for the mortgage and the foreclosure will have a negative affect on your credit report.
