my home was foreclosed on 8/18/10 no one brought it so i guess the bank owns it now. i moved out on 8/2/10 who owes the hoa fees from here on out. i filed ch7 2/6/09 was dicharged 6/09 did not reaffrim. i get a phone call from the second mortgage yesterday asking me what is going on with the house i told them you shold have all the information. i was paying the 2nd mortgage but made last payment 7/10.

Now you have been discharged from the chapter 7,as you have included your mortgage in BK so you need not worry about the further notices from second mortgage lender as it can not lead to any legal suit on your part.So be patient and just let them know that you have included your mortgage in your bankruptcy.

I know they cant do anything to me. I lived in the house a full year after the dicharge and was paying the 2nd mortgage tried a short sell had an offer 1st mortgage said no. That when I said forget it it then I owe neither one of them anything I am leaving. I kept paying my HOA and 2nd mortgage until I left on 8/2/10. 1st mortgage had auction on 8/18/10 no one brought it, so I assume they own it now correct so I should not have to pay anymore HOA fees correct? Do I call the HOA and let them know it is bank owned now or just forget about it.

If the bank owns the property now, then you're not liable for paying the HOA dues. If the property deed mentions the name of the bank, then they would be responsible for maintaining the property.
