We are currently ready to be turned down for HEMAP assistance on our Countrywide mortgage. We have tried to do modifications but they have all failed. We have a a real estate agent coming Friday to do a fair market value for us to prepare for a short sale. My question is, while the home is on the market, can Countrywide still foreclose on us even though we are actively trying to sell the house? Any advice that you may be able to offer on a short sale I would very much appreciate. Thank You!

Countrywide has all the right to foreclose the property if you are unable to pay the mortgage dues. As you are trying for a short sale, inform the lender about it. You can write a hardship letter to your lender and request for it. It will help you in stopping the foreclosure process.
