We got married last year adn I have never owned a home. Could I qualify by myself and not have his name on anything?
Rather than answer this question straight out, I would recommend speaking with a real estate attorney in your state that can advise you based on local law. Most real estate attorneys will answer the question for free if they think they'll get your business in a purchase down the road. Good luck.

A lot depends upon state law. apart from that your credit score should be more than 620.

To Destinylaw,
You can surely qualify for a home loan on you own, provided your credit score and income are sufficient to get you approved for a loan. The house, which is in foreclosure, is in your husband's name. You did not sign on the mortgage that he defaulted on. Am I correct? In case I am, then the foreclosure will not affect your credit in any way and you will be eligible to apply for a new mortgage.

Yes.
If you live in a community property State, they'll consider it 50% his, even though his name won't be on Title.
