 Hi,

I have not been paying morgage since June 2008 and last court was on May 19. As per my attorney, judge said modify loan or it is foreclosure. Unfortunately I do not contact my attorney any longer as it was a very dissappointing service. I have been trying to modify the loan but it is clear to both parties as of this Tuesday, August 11 that they can not offer me any solution. The sale date is not listed yet. I do not know what I will be going through. I have 2 kids going to school and I need to know how much more time I have before I have to evacuate the house. Can you please advise? I am also planning to ask my morgage company that I want to put the house on short sale? What do you think?

Thank you
Once you get the notice from the bank you have 30 days

Hi lacin,

Did the lender give you any reason as to why they are not giving you a loan modification? As a borrower, you can always ask the lender for clarifications. If you're not able to modify your loan, then the lender will foreclose the property. After the foreclosure sale, the lender will give you a 3 day notice period to leave the property.

Take care.
