Where do I begin. Well my question my ex girlfriend own a home joit tenancy. I moved out and she rented a room to her sister. After I left she pulled out $30,000 without my knowledge and then let the home fall into foreclosure. Can she do that without my consent. Pull out money like that?
Additional info. There are 2 loans I am on the 2nd she is on the 1st. Mine is current her's is 9 months behind. she wont sell. quit claim etc. Just trying to stick it to me. What can I do?
Thanks
Miserable Mike

you better find a good lawyer to work on your behalf, and it wouldn't hurt you to work out a deal with that other loan. how is it that she's on one loan and you're on another? are you not both obligated on both loans?
Hi Mike,
Your girlfriend is listed on the title as a joint tenant and she has equal ownership rights to the property. I believe this gives her the right to take equity out of the home. But she should have taken your permission before renting the room to her sister. However, it is indeed strange that your ex is on the first loan, while you are on the second. In case you are not obligated to repay the first mortgage, the foreclosure by the first lender is unlikely to affect your credit scores.

That is weird to have her on one loan and you on another. Is your name on the Jumbo Loan or secondary loan? If you are on the second loan, you forget about trying to salvage anything. The second loan usually has no weight when it comes to foreclosure. If you chose to move out, let her handle the mess. Walk away from it.
Well, it's been 2 months almost, and we don't have any responses from Mike; so we don't know what ended up happening. My hope is that he went out and found a lawyer who is/was able to help out in this situation. It'd be nice to hear from him again, if only because someone else may be facing a similar situation and needs help.
