Four years ago a home owner used a realitor to sell his house. Now the the current home owners are facing forclosure and thier mortgage compying has included the previous home owner's name in the lawsuit against the current home owners. Why would the morgage company sue the previous home owner when he used a real estate company to sell the house?

If the previous homeowner has sold off the property to the new owners who had refinanced the loan in their names, then the mortgage company will not be able to include him/her while filing a foreclosure lawsuit. The previous homeowner can't be held responsible for the present owners' mortgage dues.

There are only a couple or reasons I can think of.
1) It was a non arms length transaction
2) The lender audited the file and found some type of fraud or something else illegal.
