My husband and I are having a lot of marital issues. He has talked many a times about leaving me and just packing up. What are the laws when it comes to mortgages? Doesnt he have to pay for at least 1/2 of the mortgage payments even if he moves out? How does that work. We still live together and keep up all our payments on all our bills. My concern is that my home would go into foreclosure without his help. I could probably make the payment if it were only 1/2 and just get a roommate. Please advise.

If both of you are on the mortgage note, then both of you are equally liable to pay the mortgage dues. But if your husband does not pay the mortgage, then the lender may ask you to pay the whole amount.
