My divorce was finalized this month.The Judge determined the property is marital and we are both responsible for the debt. However, she did not officially grant anyone the house? My ex-wife has a prior injunction against me for domestic violence and she had temporary exclusive possession of the house for 3 years. The Mortgage note is in name only. The title is in both our names. I qualify for the Federal Making Home Affordable Program but I have to live there. What can I do at this point to save my home? How can I get her to move out?

You will have to negotiate with your ex-wife regarding this. Inform her about the Making Home Affordable Program and check out if she lets you stay in the property. However, I doubt whether or not you would be able to get her move out of the property.

However, you may even ask her to bring the loan current and refinance it in her name. Thus, she would become the owner of the property as well as will remain liable for the mortgage.
