got behind soon after a 2nd remodification morgage company was going to do it again but i gave up after they kept asking for more and more documents. I owe so much more than it's worth and just move out paying more rent than the house note. The morgage is less but full of mold and really needs new everything including a roof. It was built in the 1900 and has really gone down. what should i do. they haven't come to take the house back or anything but i can't afford to fix it.

you can apply for a deed in lieu of foreclosure in order to get rid of the property. however, it is true that it will remain the discretion of the lender whether or not he will consider your request for the deed in lieu of foreclosure. if he agrees to it, then you will be able to get rid of the property and you won't remain liable for paying off the deficient balance to the lender.
