We are losing our home to foreclosure. May we remove the chain link fence we added after we moved into the home? It was not part of the mortgage and does not touch the house.
Hi Guest,
As you added the chain link fence on your own, you will be able to remove it when you leave the property. As it was not included in your mortgage, your lender won't be able to say anything in this regard.

Hard to imagine why a fence would not be considered if the post were sunk in the ground. After acquired is not relevant; for example you put on an addition, its covered by the mortgage even if the construction is done after the mortgage is recorded.
As a practical matter, I dont see many repercussions if you simply take the fence. Even if you have a video tape of the former owners stripping the house after the foreclosure sale, police won do squat that would the poor soul whose house wastaken away from hi.

No. Anything you've purchased and "attached" to the property is considered "real property", and stays with the house. That includes faucets, air conditioning units, heaters, lighting fixtures, carpet, etc.
