My ex is living in our home and has failed to pay the mortgage. I just found out that we are over 8 months arrears and would need to pay the full amount with attorneys fees to save it from foreclosure.
1) I never received any notices because I live elsewhere, can they proceed with the foreclosure without notifying me?
2) Is there anything I can do to save the house from foreclosure aside from paying $20k that I do not have?
3) Should I notify the attorneys that my ex never gave me the change to bring the mortgage current.

You need to check out whether or not the lender has send notices in your name at your earlier address. If yes, then the lender will be able to foreclose the property. You and your ex can apply for a loan modification. If the lender accepts your request, then you'll be able to save the property from foreclosure. You may let the attorneys know about the fact that your ex never gave you the chance to bring the mortgage current. However, it won't help you in stopping foreclosure.
Feel free to ask if you've further queries.
