my sisters house was foreclosued on - my mother left it to her free and clear, but she got a mortgage. The house was sold, she was demanded to vacate and the MC filed a complaint that she forfeited the right of redemption. I told her I would file the court papers and wanted the right of redemption if I could get it back. I got a POA and paid her for a quitclaim deed. I have been working on this for weeks and now have a counter complaint to file - can I file the quitclaim deed and then file the counterclaim, or do I need to do it under POA? If I get the right of redemption it's mine ... if the foreclosure is vacated and she can come up with the money to catch up, it's hers.

In my opinion, you should contact an attorney and get his opinion in this regard. He would guide you as to whether or not you should do it under the power of attorney (POA).

thanks for reply. I tried to contact an attorney this afternoon, but I'll try again tomorrow.
I've been talking to my niece about this tonight ... we've been debating on what would be the best thing to do. She's like me, she's always liked my mama's house because it was old. I didn't know how old it really was until I looked at the tax records - it was built in 1890 ... if I can get it back we want to use it as a family fellowship hall ... there's 3 acres and plenty of parking - and she wants an outdoor kitchen.
I think I have a pretty good case against the MC for fraud ... as soon as I can find out about filing status, I'm going to give it a shot
