Can I deed the house back to my husband after foreclosure?

I am seperated from my husband and he allowed our home to become foreclosed on. My name was on the deed but I was not on the loan when he brought the house. I was told that in the state of Georgia if you are married the spouses name has to go on the deed.

You can transfer the property to your husband as the property is being foreclosed upon by the lender. However, as your name is not on the mortgage, the foreclosure of the property will not affect you. Your credit report will not get affected due to this.

Hi,

You can relax as your name is not on the mortgage deed. The lender will only not come against you if you cannot pay the loan. It will also not affect your credit score. However if you want you can transfer the property in your husband's name by signing a quitclaim deed.
