Nephew's home foreclosed and sold at auction 4/12/10. I am provided cash funds to redeem. You mention that a notice to redeem has to be filed. We have an attorney but redemption is rare so there are many unknowns. Buyer has submitted Stateme of Lawful Charges, I am ready to wire transfer the funds. But should a statement have been filed by our attorney in order to clear the way for me to finalize and will this remove the foreclosure off his record?
You should contact your attorney in order to get the notice of redemption drafted and filed. If you have redeemed the property, then you can ask your lender to remove the negative item from your credit report.
Thank you for your reply. Does the our attorney file with the Probate court? I anticipate wiring the funds today or tomorrow to the buyers atty, once we have the wireing info (since he forgot to include it in last Fridays email that transmitted "Lawful Charges") My atty wants hers to email a promise to forward the deed upon wire transfer of funds. He is to vacate this Friday and family has 10 hr drive to pack him up if transaction doesn't occur today.
