Can a home be forclosed if there is a Lis Penden case? I live in WA.
Hi Tina,
Lis Penden is a notification of pending lawsuit. It is filed by an attorney or trustee which initiates the foreclosure process once the borrower is at a default. This is a part of the pre-foreclosure process. Thus, the home can be foreclosed when there is a lis penden on it.
Thanks
