We are behind on our mortgage through Bank of America (was Countrywide). We have been in contact with them since December 2010, and in a letter from Bank of America dated 01/19/2011, were told that a re-payment plan had been confirmed ($5,000 by 2/28/2011, then regular monthly payments for a year). Got served papers from the sherifff's dept. today (2/11/2011). On top of all of this, it says in the papers that the plaintiff is Bank of New York Mellon, which is NOT who our mortgage is through. It says we have 20 days to respond. Very confused as to what we can do? I don't want to send them this money if there is no way this re-payment plan will stop the foreclosure. And what about the different banks??

You should immediately contact your lender and sort out the matter. If you already have a payment plan with your lender, then they won't foreclose your property.
