Ok so my fiance and I bought a home a few years ago. His credit was bad so only I am on the loan but we are both on the deed of the house. A while back I filed bankruptcy and included the house in it. The bankruptcy is now done with but the foreclosure process is still going on. My fiance and I are getting married in a month and if the foreclosure isn't over can they come after my fiace? Will he be responsible in any way by marrying me and being on the deed even if he is not on the loan?
Hi reneenay,
Your fiance did not sign on the mortgage note due to his bad credit, right? If he did not sign on the note he is personally not responsible for the mortgage payments even after you two get married. However, in case you are in a community property state, the mortgage can be considered as your community liability. In that case, the lender will be able to come him.
