Spouse on deed not mortgage - how will foreclosure affect us

Posted on: 24th Sep, 2009 05:04 pm
Unfortunately our house is going into foreclosure.
We live in Florida.
The deed is in both my and my husband's name,
but the mortgage is only in his name.

1. Am I responsible for the mortgage?
2. Does the foreclosure go on my credit?
3. If they take the house, am I responsible for deficit? can they put a judgment against me?

Thank you for taking the time to answer this. I appreciate it.
Please post a link to verify your answer if possible. Thank you.
To clarify, even if I am the spouse, would I not be responsible?

since you are not on mortgage, it will not affect your credit score & they can not held you responsible for deficit amount

Welcome bdzzz,

As your name is not on the mortgage docs, you won't be held responsible for the mortgage dues. Thus, the foreclosure sale of the property will not affect your credit in any way. You won't be held liable for the deficient amount nor can they place any judgment against you. Though you are the spouse, you can't be held responsible as your name is not on the mortgage docs.
