spousal non-pymt by x/doctor lead to foreclosure.

Hi I'm needing 2 answers-please. I live in Oregon. My only income is spousal support.

I was working with the bank on a loan modification which surpisingly didn't go through nor was I given any plan for repayment of missed mortgagae dues.

Aug 16th (given 3 different dates-never talk'd to same person twice) the bank took back my home.

?1. Doctor or ex hasn't paid spousal support 2 months/ alomost 3. Or my portion of ownership in practice.
Q: Do I hire a lawyer to force doc to obey the laws of our court order first
or do I file for bankruptcy first.

Q: Can I get my house back if the foreclosure date has been in the last 30-60 days? (saw return of property within last 120 days of bankruptcy) Thankyou for any info.

If the court has ordered the person to pay you the spousal support, you should contact your attorney and take legal steps against him/her. He or she is bound by the law to pay the spousal support to you. You don't have to file bankruptcy for it.

If the property hasn't been sold off at a foreclosure auction, then you can contact your lender and pay off the balance amount and other fees and get back your property.
