I got the loan to fix up my home and to repair my childrens credit. My oldest daughter took over the house payments and defaulted on 3 monbhts of payments before she informed me on the situation. When I called the company they said they couldn't talk to me because the mortgaGE WAS IN DEFAULT. They refered me to their attorney, who I called but would not discuss the matter with me in person and told me write him a letter ( This was on his message machine). I wrote him a letter in Nov. 07 asking him for the payoff, because I had someone who was interested in buying the house. He did not respond to the letter for 3 months, which by then the other party had already purchased a home. How do I begin fixing this if I can.

yes, you still need to keep attempting to contact the lender and the foreclosure attorney.
when contacting the lender, be sure to ask for someone in the foreclosure department, or in the loss mitigation department. alot of times, the "800" customer service rep is not the one who can help you. or sometimes the "800" number puts you in the collections department. always try to reach the foreclosure or loss mitigation department.
and yes, they sometimes tell you to speak directly to the foreclosure attorney. ask the lender to give you the direct phone number to the attorney. let them know that you have been unable to speak to the attorney.
you always have the right to ask to speak to a supervisor when you are calling the lender or foreclosure attorney. be sure that you tell them you need to speak to a supervisor now, tell them that you do not want to talk to someone's voicemail. (alot of times they put you on hold and transfer your call and you end up getting someone's voicemail).
be ready to talk to them about your hardship, your finances and expenses. and always ask them what can you do right now to stop the foreclosure.

I agree with Cliff you need to get someone on the phone that will talk with you. You need to know how close tolosing the home you are and what can be done to stop this. Of course this is if it isnt too late.
Do NOT let them tell you they cant talk to you someone will you just need to be persistent.
