Our neighbor knowingly set about to defraud his bank and foreclose on a home. His wife wanted to move to the yuppie area and he stopped making payments on his current home and through whatever means, purchased a new one in this new neighborhood.
All the while assuring us he would sell or rent his old house. The old house next to us was in a "short sale" status for about five months and has been vacant for nine. It had offers which have subsequently fallen out of escrow for I'm sure a variety of reasons that we know are associated with the challenges of a short sale. The home is now in "pre-foreclosure" status with an amount owing of $18,155.
This makes our property values decline, our neighborhood look terrible and who knows what kind of weird new neighbors we would get.
Can we sue for damages to property values given that he is knowingly doing this? He didn't have to move, he chose to move and cause this situation.
Any ideas?

Your neighbor deliberately fell behind on mortgage payments and is now letting the house go into foreclosure. I do understand how upset you are with the fact that it has lowered the property values in your area. But unfortunately, you cannot sue your neighbor just on the ground that he chose to let his property be foreclosed.
