being sued for foreclosure

My husband and I bought a house with 80% being financed by one mortgage company and the other 20%financed by a different company. In May 2009, my husband who had been suffering with bipolar depression, shot himself in the house. I tried to sell the house but wasn't able to and so the first mortgage company forclosed on it in December, 2009. Now the other mortgage company that paid 20% is suing me. I wouldn't have left the house but couldn't emotionally live in it due to the circumstances. I've been in shock for about a year and now this! Any advice on how I handle this? I don't own my car or home. Can they take the cash I have on hand or garnish it from my retirement check? I was granted an early retirement due to disability. I am trying to get SS disability as well because the retirement isn't enough to live on.

jeannie, i am sorry to hear about your tragic loss. is your name on that second mortgage? i hate to say this but i would speak with a bankruptcy attorney. you could also offer a payoff amount equal to lets say 10% of what is owed while indicating that if they don't accept, you will file for bankruptcy.

Yes, my name is on the second mortgage. The problem is that I can't pay even 10% because I am already not getting enough to pay my bills monthly. I am getting $1400 a month and have about $2000 + in bills. I appreciate you writing! Surely something will work out!
