forclosure and not have title

Posted on: 16th Sep, 2010 09:35 pm
In my divorce I was givin a Quit claim on a property that was bought for me in our settlement. I am not on the mortgage and now it is going in to forclosure against the borrower my exhusband. Can the bank take my house against his debt on a house I legally have a state filed quit claim and no financial liability on?
hi chrismastrobuono!

welcome to forums!

though you have the quit claim deed in your name, the lenders holds the lien on the property and can foreclose it if the dues are not paid on time. you can pay off the dues in full, then refinance the mortgage in your name in order to save the property from a foreclosure sale.

feel free to ask if you've further queries.
