There is a balance owed on the mortgage. We will pay the existing mortgage and probably not qualify for a new mortgage due to a bankruptcy.

The property is a mortgaged property- right. So your fiancé’s brother has to take consent from the lender before transferring the property to you. Now if you pay the balance owed on the mortgage, the lender may give the consent. And you are doing so. That is good.
But I cannot understand that "probably not qualify for a new mortgage due to a bankruptcy." If you pay the the balance owed on the mortgage, why do you need to get another mortgage? Are you willing to pay the mortgage with a new mortgage?
