WHAT HAPPENS TO MORTGAGE UPON DEATH OF HUSBAND

Posted on: 30th Mar, 2010 04:35 am
The mortgage to our home is in my husband's name ONLY. The deed is in both our names. Our Will states that everything comes to me when he dies.

If he should die, will the Mortgage company allow me to continue to make payments and keep the house?

Would the Mortgage company require me to apply for a mortage in my name?

Do I have to tell the Mortgage company he died?

Thank you.
welcome madison,

in case of your husband's death, it is better to refinance the loan in your name and keep on paying the mortgage dues. if you pay the mortgage dues regularly, you will be able to save the property. it is always better to refinance the loan after your husband's death as it'll help you in negotiating with the lender in case you face any kind of hardship in paying off the loan.
