Hello,
I am expecting a $1,200+ check from my mortgage company for overage on my escrow account. However, it seems to me they are holding on to my money as long as possible. There are no arrears or late mortgage payments involved. Is this legal? Thanks.

I believe they have about 45 days to return any overage.

Most lenders would take 30-45 days to send you the escrow overage. How long have you been waiting for the money. If it's already past 45 days, you should contact the lender and ask for an explanation as to why they have still not sent you the overage.
