I received a ref check for amt i had in escrow when I refinanced. I closed on 9-8-09 and WAMU was paid in full on 9-14-09. My escrow check was dated 9-28-09 i held it and deposited into my checking account on 11-5-09 only to rec a letter from my bank stating "we have received confidential info that indicates that the ck may not be paid." The check was from Chase LP Morgan who merged with WAMU. Chase now states it wl be another 20 days b4 another ck wl be issued and refuses to elec wire the money into my account so b4 I start quoting the RESPA act of 1974 does HUD have a time frame that an escrow refund is to be received. Money in escrow is my money and not an amt that was borrowed. Chase merger with WAMU ended the last wk of Oct and they will not honer checks they sent out prior. I appreciate any information

You paid the escrow money and you have the right to demand for a refund of the money. The issue may have been caused because of the merger between Chase and WAMU. I think you should wait for a few more days. If they have asked you to wait for another 20 days, if possible you can wait till then. If they still do not refund the money, you can take action and file a complaint against them.

since you delayed making your deposit, it appears that action precipitated the difficulty. given that they've told you 20 days, that seems like a not-unreasonable period of time to wait. this time, i suggest you deposit your check immediately.

Yeah it happens at timeswhen lenders agree toshort sale or deed-in-lieu before one has missed apayment. But I guess that'svery rare. They'd like tolook out for everypossibility so take up such an option ifyou haven't missed apayment.. .
