I refinanced in Nov of 2009. Shortly after, my loan was sold to Fannie Mae. We've had a series of unfortunate events in our lives and found ourselves unable to keep up with our mortgage payments. We contacted our mortgage company (US Bank) and were told that the only they could help us was if we missed 2 payments. Well, we've missed more than 2 payments since that call and now they say they can't help us and we don't qualify for a modification because we refinanced in Nov 2009. Is this true?

It is not true that you can not refinance or modify your loan just because you have did so in Nov.2009....What you can do is..you should search for another lender who wish to refinance your mortgage at lower rates..There are plenty of options out there...you can also check out with our listed lenders on this community for the free quotes....

Though you refinanced the mortgage, it shouldn't hamper your chances for a loan modification. I will suggest you to negotiate with your lender once again and try to convince him about your situation and request him to grant you a loan modification.
