whats the legality on principal and co-borrower for married?

1. the principal borrower is separated but the legal process for separation is still pending, is the spouse be part of the mortgage property?
2. is the co-borrower for housing mortgage need to be the spouse if married but separated? whats the legality on co-borrwower for home mortgage?
hi rob,

is the spouse listed on the property title? is it a community property? if the spouse is on the title, he has a legal ownership to the property. but if he is not on the title, but the home is a community property, he can claim his interest in the property, since he is not yet legally separated. as far as the mortgage is concerned, he is responsible for it as a borrower.

the co-borrower is as much responsible for the home mortgage as the principal borrower. until it is formally decided by the court as to who will take over the mortgage payments, the co-borrower will remain responsible for the mortgage. the only other way to take the co-borrower's name off the loan is a refinance by the primary borrower.

Depending on the state, if they're are not legally seperated, you might have to include the spouse's debt. I'm a little confused about the second question?
