my deceased mother owned a home with her boyfriend, her part of the home belong to me and my brother. Can her boyfriend get a loan on the home with our signature/

Is your mother's boyfriend listed on the title to the property? Did your deceased mother leave any will where she has given her boyfriend a part of the property interest? If he is not on the property title, he will not be able to get a loan using the home as collateral. If he is going to be the primary borrower, he must be listed on the title to qualify for a home loan. If his income is not sufficient, you can co-sign on the mortgage to help him qualify.

I'm assuming you meant "without" your signature. The answer is "no" as long as you're on Title, and I'm assuming you are because you're saying her part belongs to you and your Brother. But how do you really know her part belongs to the two of you? Did she state that in her Will or Living Trust? Or was it established during Probate? If her name is still on Title with her boyfriend, you've got to go through the proper legal process to get her portion of the Title transferred into your two names.
