I have been divorced for almost a year. The marriatal home has both my ex-husband name and my name on the morgage. He lives in the marital home. The divorce degree has stipulated that me ex-husband maintain the morgage until the marital home is sold. He is often late and I had even co-signed a $10,000 loan to take it out of forclosure. This has not stopped him from being late repeatedly. I wish to purchase a condo for my children and myself however, my ex-hsband's late payments are affecting my credit and having my name on the morgage is showing up as my owning realestate. Is there any ideas on how I could get me name off the morgage?

you can request the lender to release you of your mortgage liability. the other way is to get it refinanced in his name, which i don't think is possible in this situation. did the divorce decree stipulate that he had to refinance it in his name? in case it did, you can take legal action against him for which you need to consult an attorney.
