My spouse and I have been separated for 4 years. I filed a pre-app for a mortgage loan, but the loan officer said that I would have to include spouse's info for credit check/loan app since we are still married in the state of LA. Someone mentioned filing a post-nuptial agreement. What does this entail?

Hi chevnate,
As you are not divorced, your wife still holds an interest in your property, which is why the lender would want to know her credit info and include her in the loan. A post-nuptial agreement could be a good option until you are legally divorced. It is an agreement that states clearly how the property will be divided among the spouses in case the marriage ends in a divorce. Thus, it will become clear who is going to own the property after the divorce and the lender will not have to include your wife's name to offer you the loan.
