take the name off the mortgage

My ex refuses take my name off the mortgage. She says that she can't take a mortgage on her sole name. The only way is sell the house, but she lives there w 2 kids so she knows the court won't get her sell it.I have a solicitor, but it does't look good. I lost hope. What can I do?

if you want to take your name off the mortgage, your ex need to refinance it in her name. but if she does not qualify due to bad credit and other reasons she will not be able to refinance. but, is the mortgage current? has she been making the monthly payments on time? what is the reason for her not being able to refinance? is it her credit score or income?

Hi jenkin7,
her solicitor says that she ''tried'' to refinance it in her name, bad she has more then 10 000 on credit cards and ''poor income'' - I know that she is on minimum 18 000 a year - she works full time and I pay for the kids, she has money from goverment. Her solicitor said that she is not going to tell my solicitor what is her income. She has been making the monthly payments on time so far.

it is possible for her to take over the liability of the loan through a simple assumption or a novation. but the lender will definitely check her credit score and income before appoving either an assumption or a novation. what is her credit score? has she been making timely payments for the past 12 months?

Yes, she has been making timely payments for the past 12 months. Her credit score is over 10 000 - maybe more, she doesn't want to say.

What is this credit score? It is not possible to have 10,000 credit score.We are talking about FICO or experian either of which you can provide. :arrow: :arrow:

manoj there is some sort of alternate universe that operates here and looks just like our own. in that alternate universe there might just be the possibility of scores up to 10,000.

we really don't know for sure, though.
