my mom & i refinanced our home in 2006 in il and we filled out a quitclaim deed as joint tenants with right of survivorship & not as tenants in common.
my mom recently passed away in extremely fast bout with pancreatic cancer.
she had no health insurance so i am trying to change the mortgage out of her name.
but the mortgage company we refinanced with who setup the quitclaim deed states its a non assuming mortgage.
so what can i do?

I would suggest you to go through the property deed in order to check if anything is mentioned on it regarding the mortgage. The property deed will only mention the details about the property and not anything about the mortgage. You may even contact other lenders to check out if they can refinance the loan for you.
