My 81 year old mother added my name to the title of her home after her second husband died. She now wants to remove my name as we have had a falling out. Can she do this without my knowledge or signature? There is no mortgage. The home is in Illinois.
Thank you
Thank you
can a name be removed from a house title without the knowledge of one of the persons by quit claim?
no and no.
in order for title to change hands once again, you would have to be in agreement and you'd have to voluntarily cede your interest in the property. of course, your mom could bring an action in court to accomplish this as well, but that's probably (hopefully) not being considered.
the best bet is for you to patch things up so that in her waning years, she can take comfort - again - in the relationship that you two (used to) have and can claim once again.

>>No. Not without court action. But she'd have a difficult time in court if you disapproved.
