can a loan be remodified in one spouse name but leave the title in both names ?

My wife and I are separated. She want to keep the house and try to get the mortgage reduce so she cna affor it herself in her name only, can I keep my name on the title and just take my name off of the mortgage, just in case she sells it when the market goes back up. I want to get some money out of our house. I just don't want to give her a 600,000 house that I have help pay for in the past five years . Help me !
if you are both on the loan then she would have to refinance it in her name and qualify for the payments alone. this leaves you out. talk to your atty, you may be able to stipulate in the decree you get "x" amount of dollars when the property is refinanced or sold. good luck

What do you mean by separated? Are you divorced from her ?

If she wants to keep house on only on her name, You can contact to your mortgage company to make this changes. Then she only responsible to pay mortgage loan If she wants. Before that you must remove your name from co - signer.

If you paying from 5 years for mortgage of home, Yes you can keep your name on the title and just take your name off of the mortgage, If she selling this home he can't take all amount alone. If she think to take all amount you can take her to court & charge case of him about that. She can't do this without your permission because you paying for mortgage 5 year & you also having part in the property.

If she doing this i would like to advice you that take her in court & I hope court will give justice in you Favor.
