chapter 7 bankruptcy

Posted on: 30th Jan, 2011 02:10 pm
I was granted a discharge of debt in a chapter 7 bankruptcy.I did not reaffirm the mortgage debt in the filing and have been making a payment I can afford at this time. What I am able to send is less than my full payment. Can the lender foreclose on me?I want to stay in my home.
Hi schwartz,

As you haven't reaffirmed the mortgage, you won't be liable for paying off the dues personally. In such a situation, the lender can foreclose the property though you make partial payments.

Thanks
