I have loaned my mom money which she cannot repay. Can we write a quitclaim deed with consideration as her granting her house to me as grantee in lieu of her repaying the debt she owes me? We both live in Texas, and the property is in Texas.
Hi northpenn,
Your mother can sign a quitclaim deed and transfer the property to you as she is unable to pay you the money that she had borrowed from you. Your mother can contact a real estate attorney in order to get a quitclaim deed drafted from him/her.
