Husband in jail, home being forclosed on

Posted on: 01st Jul, 2011 04:41 pm
My husband is sitting in jail for an undetermined amount of time (for family violence). Our divorce has been filed, but is still pending. Our house is being foreclosed on. My name is not on the loan so the mortgage company won't talk to me at all. My name is however on the Deed of Trust but I'm not sure what that means? We were married when the home was purchased.

I received notice that the house is being auctioned on July 5. I have nowhere to go. I have 2 children. How much time do I have before I am locked out and risk losing our possessions or am forced out of our home? We are in Texas and I am worried sick about what happens next. thank you.
Welcome veryscared,

After the foreclosure sale gets over, you will receive an eviction notice from your lender which will mention the time period within which you'll have to leave the property.
