around 3/1/11 we contacted citi mort concerning my wife's possible layoff, which did happen. they said that we wouyld be required to go through another loan mod(wouldn't qualify, plus we would have to go through another 1 of their run around) short sale, or turn keys into them with deed in lieu.
on 5/2/11, citi mort send a letter telling us we were in default, not registered or certified mail. no signantured was required
on 6/6/11 citi mort cent a letter the says "re: foreclosure advoidance notice". basically it says thet they are required to contact us to "explore options to avoid foreclosure" the letter has a certified at the top of the see-through top of the envelope. it doesn't seem to be a real post office certified letter, plus no signature was required.
on sun., 6/17/11 we received a door-hanger notice to contact them.
we have never received anything registered or certified that we have signed for
question is are we really in default or are these notices just to pursuade us to communicated with them?
trying to talk with them is never a consistant or assuring answer.
btw we finialized our bk a year ago and never reaffirmed to loan except for a loan mod that states noting about the reaffirmation

Most lenders have yielded to the pressure from the government and the public for wrongful foreclosure and for not allowing the proper time to allow homeowners to find solutions to foreclosure. Just call your local title company, or the title company that closed your loan and ask the customer service to see if you have a recorded NOD. The bank will not tell you the right answers as each time you call you speak with a different representative and you have to re-explain your situation again...Find out for sure by contacting your local records office or title company and go from there. That's not the key word, of course, though it's usually used by lenders only when someone is seriously delinquent (60-days and more). They'll insist that foreclosure proceedings have begun before they've even taken the first step to that if they can persuade you to make payments.
