Old dorm charge

Posted on: 11th Aug, 2011 12:21 am
i received a letter in the mail regarding an old housing/dorm charge i incurred when i left the school (around 10-11 years ago!!) well… i had filed chapter 7 bankruptcy and got a discharge from it in 2010. now, i’m getting this letter from a collection agency saying that i owe money. the debt is not even showing up on my credit report. i don't know where to look up the sol for something like this. i thought this was covered in my bk. but i’m not sure. what if it is not included in the bankruptcy?
Hi babyrocker,

As you haven't named the state you live in, I will suggest you to contact a local attorney and check out the SOL for such debts in your state. If the SOL is over, then the collection agency won't be able to take any legal actions against you. As you had filed bankruptcy, I will also suggest you to contact your bankruptcy attorney and check your bankruptcy discharge papers in order to find out whether or not the debt has been discharged.

Even if the debt has not been discharged in your bankruptcy filing, I still think that it might have passed the SOL. In such a case, you may not have to pay that debt. However, the bankruptcy attorney has the rights to contact you for the debt.

Thanks,

Jerry
