In 1983 My mother, youngest brother all bought property in Florida together. When a dispute came up in 2000 my brother sold his share to my mother and me and a quitclaim deed was filed to this effect.
My mother is elderly, with a life threatening illness, my other brother, whose name has never been on the deed is trying to force me to sell the property, has threatened to have my name removed from the deed (he cannot) I need to take over management of the property, my mother has a blood clot on her brain. No one will tell me if she is competent, my brother is not allowing her to communicate with me or other family members close to me. My brother has threatened that my mother is going to stop making mortgage payments which are paid by rentals on the property. My mother has always been in charge of this because she needed the income.
I cannot afford an attorney and my brother knows this! I need help, I am 52 and retired with an extremely small income.

A person who is not on title is not able to sell or do anything with the property. Are you on speaking terms with your mother? Have her sign a General POA for you to take over the property, renters, management, income and expenses, and give Mother the income received. Your brother has no right apparently to the property, but if your mother stops making payments, then the home will be foreclosed, and no one will benefit. Good Luck
