Appraisal refund?

My loan was scheduled to close in 4 days, yet my lender still hasn't received the appraisal back. The appraiser is claiming he had difficulty getting into the home, and that he had tried over and over to contact someone to set up a time to come see it. The issue with this claim is that it is an unoccupied, new construction home. And neither my realtor nor the seller ever received contact from this individual. Either way, he doesn't need anyone to "let him in," seeing as it's an unoccupied, new home, right?

Shouldn't my Loan Officer have given the appraiser that information? Why was a deadline not set to ensure everything was done by expected closing date?

We scheduled our closing date on day number 53 of our FHA loan. Even though we've heard it's a 45 day maximum in most cases, we wanted to give as much time as possible to avoid these issues. Yet, now we're going to have to pay daily fees for closing late.

I paid for an appraisal on the home, and it was done in a fashion that forced me to attain financial loss due to either the appraisers incompetence or my Loan Officer's. My question is, do I have grounds to ask for that money back? Or what money may I be able to recoup? I stand to lose a good chunk because of this.

The loan officer should have given the information to the appraiser and set the date as per requirement. This would have helped you to avoid the hassle. As far as what actions you can take or whether or not you can get back the money, this can be better told to you by an attorney.
