Hi there… We decided to walk away from our home on Nov 2011. We filed for bankruptcy this year, and it was final in July 2012. We moved out of state on August, 2012. The house went up for trustee's sale in the same month. Our lender was GMAC, and they now own the property. We received an eviction notice in September, but I didn't think much of it since the house was vacant. I guess we should have done something in response to "surrender possession". We are now served with a summons for Unlawful Detainer - Eviction, which states that we did not comply with the requirements of the 3-day Notice to Vacate, we continue in possession of the property, and they are charging us rent on a daily basis from Sept 25 onward. Holy hell!! Now what? We have 5 days to respond in writing through the proper legal forms. How do we make sure we aren't charged for all this rent?

The lender has the right to charge you the rent. It will be difficult for you to get that waived off. Nevertheless, you can contact the lender and negotiate with him so that the rent gets waived off.
