Mortgage Charge-off on property deeded to HOA

Posted on: 23rd Jan, 2014 09:51 am
2.5 yrs ago I filed for Chapter 13. Had a condo that I surrendered, so the br lawyer had me sign a Quit Claim Deed to deed it back to the condo homeowners association. Now I'm trying to buy a house, and found out the the mortgage was charged off, not assumed by homeowners association! Basically I owe $100k on a condo I don't even hold a deed to....any suggestions on recourse?
Hi Suzunow,

Well, you are in a tough situation. You will have to get in touch with your bankruptcy attorney and check out whether or not you will be liable for paying the charged off debt. Didn't you get a repayment plan to pay off the loan while you were in Chapter 13 bankruptcy filing?

Thanks
