Our contractor did a horrible job on our new construction. We paid him for the sheetrock and painting, and he did not fix the issues. We've had several contractors who have given estimates of the damage. He refuses to fix the issues and even wants the last amount left over from our loan. He has been paid for all items he has done...good and bad services. Our deed of trust states that he can not do this because he is giving false items that he says we owe him for. He has titiled them: Add0ons and changes. Our deed specifically says that he will "not be allowed to make charges" of "Alteration and extras." Why is the bank allowing this? AND is this legal? What can we do to close on our house? He has not filed any other legal lein, but abandone our uncompleted home over 4 weeks ago.
If it is specifically written in the deed that he will "not be allowed to make charges" for "Alteration and extras", then the contractor can't charge money. You can consult an attorney regarding this issue as the contractor has broken the contract.
